For the treatment of data of our users, we implement all the technical and organizational security measures established in the current legislation.

We also want you to understand that the personal data is mandatory to contact, subscribe to this blog and conduct business with The Ocean Spell. Therefore, if you do not provide the personal information requested in the different contact forms or do not accept this Privacy Policy, we will not be able to carry out the requests you ask.

  • Information you provide when formalising a booking for a trip, including your name, contact details, postal address, residency, identification number, for fiscal matters like tracking your transference, doing invoices. 

  • Information you provide once booked and prior to the trip, including all the above and passport number, expiry date,  insurance company, policy number, flight details, emergency contact, any medical or health information we need to know to make sure we can meet all the needs during the trip (including allergies, health information, medical). 

Through all these ways it is the user who provides the information. When the user is required to enter an e-mail address or other contact information in order to access any of the services, we will always offer the possibility, at the very least, of opting out of marketing and advertising e-mails and communications by sending us an email to info@theoceanspell.com or with the unsubscribe link on the newsletter email.

You may decline to provide us with your information. However, this will limit your ability to register for our services. 

How we use this information? What purpose?

The purposes for which data is collected and managed in www.theoceanspell.com depends on each capture system (forms):

We request the following personal data: Name, Email, Telephone, to request any of the services that theoceanspell.com makes available to its users. The information collected will allow requesting the corresponding service for a possible offline processing of it. Should The Ocean Spell not have the subject's personal data, it will inform the subject of this within one (1) month.

The Ocean Spell may deny access to personal data in the following cases:

  •  When the right has been exercised in the twelve (12) months prior to the request, unless proof of a legitimate interest is provided to this end;

  •  When this is contemplated by a Law or Community law regulation that is directly applicable, or when such regulation prevents The Ocean Spell from revealing to subjects the processing of the data to which the access refers.

In any case, we will inform the subject of its right to exercise tutelage before the Spanish Data Protection Agency.

RIGHT OF RECTIFICATION/CORRECTION

The entitlement of an individual to request that The Ocean Spell complies with its obligation to maintain accurate data, amending personal data when they are inaccurate or incomplete.

Data rectification request should indicate which data is referred to and the correction to be made, and should include documentary proof that the amendment is necessary. The user can email to info@theoceanspell.com

The Ocean Spell will issue a decision on the rectification request within a maximum of ten (10) days as of the date of reception of the request. After this time, if no response to the rectification request has been received, the subject may file a claim with the Spanish Data Protection Agency.

If we do not have the subject's personal data, we will inform the subject of this within ten (10) days.

Should the rectified data have been previously ceded, we will communicate the amendment to the transferee, within an identical period of time, so that the transferee may amend the data, within ten (10) days of reception of the communication.

The Ocean Spell may deny rectification of personal data in the following cases:

  •  When this is contemplated by a Law or Community law regulation that is directly applicable, or when such regulation prevents The Ocean Spell from revealing to subjects the processing of the data to which the access refers.

In any case, we will inform the user of its right to exercise tutelage with the Spanish Data Protection Agency.

RIGHT OF CANCELATION

The entitlement of an individual to request that The Ocean Spell excludes from processing all or part of their personal data when they are inaccurate, inappropriate or excessive, or when their processing does not comply with the LOPD. Likewise, the subject may request cancellation without the previous grounds.

Cancellation will keep data available only to the public administrations, judges and courts for the purposes of determining any liability arising during the period of proscription. Once this period has elapsed the data is erased.

We understand that if you do not expressly request cancellation of your personal data from our files, you are still interested in having them remain there, provided this is appropriate for the reason they were obtained.

  •  Photocopy of ID card or an equivalent identification document accrediting the identity of the interested party or their representative; and, in the case of the latter, accreditation of this representation in any legally valid form that provides reliable proof or in an attested declaration by the interested party.

The Ocean Spell will issue a decision on the cancellation request within a maximum of ten (10) days as of the date of reception of the request. After this time, if no response to the cancellation request has been received, the subject may file a claim with the Spanish Data Protection Agency.

If we do not have the user´s personal data, it will inform the subject of this within ten (10) days.

If the cancelled data had been previously ceded, we will communicate the amendment to the transferee, within an identical period of time, so that the transferee may cancel the data, within ten (10) days of reception of the communication.

The Ocean Spell may deny cancellation of personal data in the following cases:

  •  When the data must be stored for periods established by law or in the case of a contractual relationship;

  •  When this is contemplated by a Law or Community law regulation that is directly applicable, or when such regulation prevents The Ocean Spell from revealing to subjects the processing of the data to which the access refers.

In any case, we will inform the subject of its right to exercise tutelage before the Spanish Data Protection Agency.

RIGHT OF OPPOSITION

The right to object or of opposition means that the user has the right to not perform the processing of your personal data or we cease therein in cases where consent to treatment is not necessary, concerned file commercial prospecting or that have the purpose of adopting decisions referred to the interested party and based solely on the automated processing of your data.

After this time, if no response to the opposition request has been received, the subject may file a claim with the Spanish Data Protection Agency.  If we do not have the user's personal data, it will inform the subject of this within ten (10) days.

RIGTHS IN RELATION TO SOCIAL MEDIA CHANNELS

In relation to the rights of access, rectification, cancellation and opposition in the processing of data through social media channels, keep in mind the following:

 

Access is defined by the functionality of each social network and the ability to access information according to the configuration you have designed for your profile.

We can only rectify the rectification in relation to that information that is under our control, for example, delete comments posted on this page from a linked social network or our profiles on social networks, provided they are not by third parties.     • Hosting: Cdmon, based in Spain,. treats the data in order to perform its hosting services at theoceanspell.com.

    •  Advising fiscal agency: Gestoría Laborlex S.L., with address at Avda. Andalucia, 31, 29006, Málaga (SPAIN), deals with the data in order to carry out its advisory / management / fiscal services to Silvia De San Laureano Quiñones.

    •  Email marketing: Mailchimp, based in the US, deals with the data in order to perform its email marketing services to Silvia De San Laureano Quiñones.

    • Relevant data needed to be provided to  customs, accomodation providers or other services you have booked when hiring our surf travel organiser services, this data will be given once the user´s consent has been formalised, accepting the contract. Some of this data will be mandatory, as established in the contract of the services you have booked. 

 

Information that’s shared to protect The Ocean Spell and comply with the law:
